So if you read my first post, you understand about my cow dilemma. I have had cattle crossing my West field, three times now. What can I do about it you may ask? That's just it! I can't do a damn thing! At least that is what I'm told....
The realtors claim they knew nothing....but the sellers and the title company can be proven to be at fault...
Obviously the sellers knew of my "little" cow problem as they previously lived here and let's face it, there is no way you can miss one cow, let alone a whole herd. Ironically enough, this was not disclosed in the seller disclosures. Hmmm....I think somebody had a fubar!
The title company only came up with two areas of easement. None of which were the cattle easement or nearly as large as said cattle easement. "We don't go that deep" They tell my mom. Dude, that is your job! You should go that deep, deeper in fact....
So what now you may ask?
Well for starters, I file a claim against my title company (thank gods for title insurance!). From there we decide what would be "fair". Where the land that the cattle is being driven over is essentially useless to me, as I can't do anything with it for there will be cows crossing twice a year, I feel I should be compensated for the loss of the land I paid for. Seems fair to me. I also believe a fence should be erected approx. twenty feet from the original fence to keep the cattle contained. Seriously, what makes this cowboy think it's ok to drive his cattle through the CENTER of my property?! Have some respect asshole! Get your cattle as close to the fence as possible to minimize damage to my land!
I will keep you updated as to what happens with the cows. If my mom had her way, ya'll would be getting cow for Christmas! You do the packaging, we'll take care of the slaughter.
While I appreciate her form of justice, I don't believe it's very practical....oh well.....
